KIPPER TOOL COMPANY LIMITED WARRANTY
Kipper Tool Company (“Kipper”) warrants to its purchaser that upon delivery to its purchaser all Kipper products will conform to the specifications provided with or referenced in the purchase order for the product (hereinafter “Specifications”) and shall be free of any claim of any third party. Kipper further warrants that upon delivery to its purchaser all Kipper products shall conform to any statements made on the containers or labels for such product (hereinafter “Statements”). Kipper shall repair or replace a Kipper product if it receives written notice of any nonconformity with the Specifications or Statements within thirty days of delivery of the product to its purchaser, and upon conclusion of the thirty-day period extending from the delivery of the product to its purchaser Kipper’s warranties shall expire. Kipper makes no further express warranty and makes no implied warranty (of marketability, fitness for a particular purpose, or otherwise) regarding Kipper products or their components. Kipper transfers and assigns to its purchaser all manufacturer’s warranties applicable to the components within a Kipper product, and for the duration of each manufacturer’s warranty, respectively, Kipper shall, upon request, provide assistance and facilitate the owner of a Kipper product in obtaining manufacturer’s warranty coverage and benefits which then exist and remain in effect but shall have no obligation to honor the manufacturer’s warranty and shall have no liability for breach of the manufacturer’s warranty.
Kipper provides no warranty for any product subjected to abnormal use. For purposes of this warranty, “abnormal use” includes, without limitation, misuse, accident involving severe impact, modification of the product, unreasonable use, abuse, neglect, lack of maintenance, use in production-related service, and use after the product is significantly worn. With regard to tool storage units, “abnormal use” also includes, without limitation, a unit being pulled by a mechanical vehicle, rolled over large drops, stored or used in a corrosive environment, used as a step stool, overloaded, or modified.
Warranty claims are to be directed in writing to Kipper Tool Company, Warranty Department, as follows: by e-mail to warranty@kippertool.com; by United States Mail to P.O. Box 1750, Gainesville, Georgia 30503; or by courier or hand delivery to 2375 Murphy Boulevard, Gainesville, Georgia 30504. Warranty claims should include the item manufacturer and part number as well as a description of the product failure. E-mail has proven to be the best preference for warranty claims, but Kipper welcomes claims and related correspondence by the other methods described above. Although warranty claims must be in writing, telephone inquiries regarding warranty claims or information may be made to 1-866-380-0889.
